Actor Accuses Filmmakers of Harm and Sues

February 3, 2002 — According to the Associated Press, a background actor in Planet of the Apes has sued Fox for "alleged fraud, battery, conspiracy and negligence", accusing the filmmakers of harming him and hundreds of others with dust used in the climatic desert fight scene. According to the lawsuit, about 80,000 pounds of Fuller's Earth, a sedimentary clay used for absorbing chemicals and oils, were tossed into the air with giant wind machines. The actors were exposed to the dust for hours at a time without breathing masks, the lawsuit claims. It is unclear whether other background performers have joined the lawsuit.
